Quality Productions Terms

Sessions
Sessions are booked on a first come, first served basis. A 50% deposit is required upon studio reservation. Full payment is due upon completion of the session.

Overdue accounts will be charged 5% of outstanding balance. Previously approved credit accounts are due within 30 days of invoice date. All invoices shall be deemed final and acceptable to client unless written notice is received within 15 days of the invoice date. We will retain a proprietary interest in any or all work performed until all balances are paid in full. In the event that we incur expenses in collecting the outstanding balances, we shall be entitled to the said cost and expenses.

Cancellation Policy
Sessions may be rescheduled prior to 48 hours of the start date and time reserved without any penalty. No deposits will be refunded. All deposits are final. Deposits or cancellations prior to 48 hours will be applied to the rescheduled session. Sessions cancelled within 48 hours of the appointment start time will result in forfeiture of the deposit.

Release of Master Tapes
Quality Productions will not release original master tapes, including, but not limited to multi-track tapes, DAT tapes, 2” tapes, audio CD’s, CD-ROMS, or any other finished product until the following conditions have been met:

 

Full payment has been received on all invoices for studio time and materials.
Tapes will only be released to authorized personnel representing the client.
Upon delivery of master tapes from Quality Productions, the client acknowledges that the tapes are being accepted as technically satisfactory and releases Quality Productions from any further liability regarding the masters.
 

Client Responsibilities
Client assumes all responsibility for the condition of all Quality Productions property and agrees to be responsible for repairing and/or replacing any property or equipment that was damaged as a result of clients’ carelessness, negligence, or misuse. It is further understood and agreed that Quality Productions is not responsible or liable for any loss or damage to any of the client’s property left on the premises.

Indemnification
Client represents and warrants the film, video, tape and/or audio materials delivered to Quality Productions do not in any way defame, violate or infringe on copyrights, civil rights or privacy, or any other rights of any person, film or corporation. Client agrees to indemnify Quality Productions and its officers, directors, agents, and employees against and hold each of them harmless from any and all claims, costs, losses, detriments, and expenses of any kind or nature, including, without limitation: attorney’s fees and costs incurred by Quality Productions through any breach or alleged breach of any representation, warranty, or agreement, made by client.

Liability
For loss or damage to client from defects in material, equipment and/or negligence of Quality Productions’ personnel, Quality Productions will again perform the recording service without charge but all damages, consequential or otherwise, are expressly assumed by client. Quality Productions makes no warranties, express or implied, with reference to services and/or personnel furnished by it, and shall not be liable for any delays in the delivery of supplies, material or work on the product, nor any failure to perform the services for any cause whatsoever, including, but not limited to, acts of God, fire, strike, labor disturbance, civil commotion, acts of government, or its agencies and officers, or any other regulation, ruling or action of any labor union or association of employees affecting Quality Productions or the industry in which it is engaged.

Unclaimed Tapes
Client acknowledges and agrees that the studio may dispose of and will in no way be responsible for any unclaimed and unrecovered tapes as follows:

 

With respect to rented multi-track tapes, these will be deemed unclaimed and may be erased 30 days after the beginning of the recording session or ten days after completion of those recording sessions, whichever occurs first.
With respect to tapes left at Quality Productions for which there is an unpaid balance, these will be deemed unclaimed and may be erased 60 days after the last signed work order.
With respect to all other unclaimed tapes left at Quality Productions for twelve months, with a paid balance, these will be deemed unclaimed and may be erased twelve months after last work date.
